Terms of Service

1. Acceptance of Terms

By accessing or using Socialweb at socialweb.choice.zone ("the Service"), operated by Choice OMG ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Choice OMG, a company incorporated under the laws of the Province of Alberta, Canada. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

Socialweb is a social media scheduling and management platform that allows authorized users to connect their social media accounts, create and schedule posts, manage media, and view engagement analytics across multiple platforms.

The Service integrates with third-party platforms including, but not limited to, Facebook, Instagram, Google Business Profile, LinkedIn, X (formerly Twitter), YouTube, TikTok, Pinterest, Reddit, Threads, Bluesky, Mastodon, Discord, and Slack.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability or that posts will be published successfully to any third-party platform.

3. Eligibility and Account Registration

3.1 Eligibility

To use the Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Be authorized to use the social media accounts you connect to the Service
  • Have an active Google account for authentication

3.2 Account Creation

Account creation requires authentication through Google OAuth. By signing in, you authorize us to access your Google account profile information (name, email address, and profile picture) solely for the purpose of creating and maintaining your Socialweb account.

3.3 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately at admin@choice.marketing if you suspect unauthorized access to your account.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable federal, provincial, or local laws or regulations, including Canadian privacy laws (PIPEDA) and anti-spam legislation (CASL)
  • Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
  • Post, schedule, or distribute spam, malware, phishing content, or other malicious material
  • Harass, bully, threaten, defame, or discriminate against any person or group
  • Post content that is obscene, hateful, or promotes violence
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure
  • Use automated tools, bots, or scripts to interact with the Service beyond its intended functionality
  • Reverse engineer, decompile, or attempt to extract the source code of the Service (except as permitted by applicable law)
  • Violate the terms of service, community guidelines, or acceptable use policies of any connected third-party platform
  • Use the Service to send unsolicited commercial messages or conduct marketing activities that violate CASL
  • Collect, harvest, or store personal information of other users without their consent

5. Third-Party Platform Terms

Your use of the Service in connection with third-party social media platforms is subject to the terms and policies of those platforms. You are responsible for complying with all applicable third-party terms when using the Service to post, schedule, or manage content on those platforms.

5.1 Meta Platforms (Facebook and Instagram)

When connecting Facebook or Instagram accounts, you acknowledge and agree that:

  • Your use is subject to the Meta Platform Terms and Meta Developer Policies
  • We access Facebook and Instagram data through Meta's official APIs to publish content, retrieve analytics, and manage your connected Pages and profiles
  • We do not sell, license, or sublicense any data obtained from Meta platforms
  • We do not use Meta platform data for surveillance, profiling, or any discriminatory purpose
  • We do not use Meta platform data to build or augment user profiles for purposes unrelated to this Service
  • Meta platform data received through the Service is subject to Meta's data use restrictions and our Privacy Policy
  • You may revoke Socialweb's access at any time through Facebook's Apps and Websites settings
  • Upon revoking access, we will delete your Meta platform data in accordance with our Privacy Policy and Meta's requirements

5.2 Google Services (Google Business Profile, YouTube)

When connecting Google accounts, you acknowledge and agree that:

  • Your use is subject to the Google API Services Terms of Service and Google API Services User Data Policy
  • Socialweb's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements
  • We use Google data only for purposes directly related to providing the Service (publishing posts, retrieving analytics)
  • We do not use Google user data for advertising, retargeting, or marketing purposes
  • We do not transfer Google user data to third parties except as necessary to provide the Service
  • Google Business Profile data is retained for no more than 30 calendar days in accordance with Google's API terms. If you disconnect a Google Business Profile account, we will disassociate it and remove all permissions within 7 business days. You will be notified within 48 hours of any changes made to your business listing through the Service
  • You may revoke access at any time through your Google Account permissions

5.3 Other Platforms

Each connected social media platform has its own terms of service and privacy policy. By connecting an account, you represent that you have read, understood, and agree to the applicable platform's terms. We are not responsible for the actions, content, information, or data of any third-party platform.

6. Content

6.1 Your Content

You retain all ownership rights in the content you create, upload, or schedule through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit Your Content solely for the purpose of operating and providing the Service, including publishing scheduled posts to your connected social media accounts.

6.2 Content Responsibility

You are solely responsible for Your Content, including its legality, accuracy, and appropriateness. We do not endorse, pre-screen, or guarantee the accuracy of any user content. You represent and warrant that you have all necessary rights and permissions to post Your Content on the connected platforms.

6.3 Content Removal

We reserve the right (but have no obligation) to remove or disable access to any content that we determine, in our sole discretion, violates these Terms or applicable law.

7. Intellectual Property

The Service, including its software, design, features, documentation, and all related intellectual property, is based on the open-source Postiz project and is subject to its applicable licenses. Our customizations and branding are owned by Choice OMG. You may not copy, modify, distribute, sell, or lease any part of our proprietary customizations without our written permission.

8. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta's Personal Information Protection Act (PIPA), and other applicable Canadian privacy legislation.

By using the Service, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. You acknowledge that some of your data may be transferred to and processed in jurisdictions outside of Canada when posted to third-party platforms.

9. Data Deletion

You may request deletion of your data at any time by:

Data deletion requests are processed within 30 days. Deletion is subject to any legal obligations requiring us to retain certain data.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT SCHEDULED POSTS WILL BE PUBLISHED SUCCESSFULLY TO ANY THIRD-PARTY PLATFORM. THIRD-PARTY PLATFORMS MAY CHANGE THEIR APIS, TERMS, OR POLICIES AT ANY TIME, WHICH MAY AFFECT THE FUNCTIONALITY OF THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHOICE OMG, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Choice OMG and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any third-party rights, including the terms of any connected social media platform; or (e) your violation of any applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, requests from third-party platform providers, or discontinuation of the Service.

Upon termination, your right to use the Service ceases immediately. Your privacy rights (including the right to access, correct, and request deletion of your personal information) remain in effect for 30 days following termination. You may request deletion of your data in accordance with Section 9 of these Terms.

Upon discontinuation of the Service, all third-party platform data (including Meta and Google data) will be deleted in accordance with those platforms' requirements. Sections 6.2, 7, 8, 10, 11, 12, 15, and 16 survive termination.

14. Modifications to Terms

We may modify these Terms at any time by posting the updated Terms on this page and updating the "Last Updated" date. Material changes will be communicated to registered users via the email address associated with their account. Your continued use of the Service after any modification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and request deletion of your account.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, located in Edmonton, Alberta, Canada. You irrevocably waive any objection to the venue or jurisdiction of such courts.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Choice OMG regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, provided that the assignee agrees to honor all existing privacy obligations under our Privacy Policy and applicable Canadian privacy law.

17. Security Vulnerability Reporting

If you discover a security vulnerability in the Service, please report it responsibly by emailing admin@choice.marketing with the subject line "Security Vulnerability Report." We will acknowledge receipt within 5 business days and work to address verified vulnerabilities promptly.
